IACHR Hearing on the Impact of U.S. Forced Deportations to Third Countries
Refugees International joined 22 immigrants rights organizations in a public hearing held by the Inter-American Commission on Human Rights (IACHR) in Guatemala City, Guatemala on March 11. The hearing examined the Trump administration’s widespread and escalating use of third country transfers to expel and deport asylum seekers and migrants to countries where they have no legal or personal ties and where they face serious harm. The Commission will now assess the evidence presented to inform its recommendations to States involved in transfer agreements that violate international human rights law and international obligations.

We appreciate the Commission’s public expression of concern regarding outsourcing policies, as reflected in previous press releases. We hope that these releases will continue to be published and updated with new information.
We also believe it is time to move forward with an operational, technical, and dynamic document that specifies the human rights obligations of the countries in the hemisphere that have signed these agreements and that obligates them to be held accountable.
Therefore, we request that the Commission consider issuing a thematic resolution, as it did in 2025 on other pressing issues in the Americas. A resolution on the transfer of migrants to third countries will help guide and clarify States’ human rights obligations, particularly to ensure the principle of non-refoulement and the prohibition of torture and cruel, inhuman, or degrading treatment.
Furthermore, we request that the Commission consider seeking an advisory opinion from the Inter-American Court of Human Rights to interpret the American Convention and other applicable human rights treaties in the Americas in relation to expulsions to third countries. We request that NGOs be consulted when formulating the questions for the advisory opinion. We also request that the Commission continue to request information from States.
We also appreciate the presence of the United Nations Special Rapporteur and the Regional Representative of the Office of the High Commissioner for Human Rights (OHCHR) and ask that both agencies conduct country visits to continue monitoring these violations.
I want to reiterate our gratitude for this opportunity and ask the IACHR to continue fostering this dialogue with civil society organizations.

Agradecemos la expresión pública de preocupación de la Comisión respecto a las políticas de externalización, reflejada en comunicados de prensa anteriores. Esperamos que estos comunicados sigan publicándose y actualizándose con nueva información.
Creemos también que es hora de avanzar con un documento operativo, técnico y dinámico que especifique las obligaciones en materia de derechos humanos de los países del hemisferio que han suscrito estos acuerdos y los obligue a rendir cuentas.
Por lo tanto, solicitamos a la Comisión que considere emitir una resolución temática, como ya lo hizo en 2025 con otros problemas apremiantes en las Américas. Una resolución sobre las transferencias de migrantes a terceros países ayudará a orientar y aclarar las obligaciones de los Estados en materia de derechos humanos, particularmente para asegurar el principio de no devolución y la prohibición de la tortura y los tratos crueles, inhumanos o degradantes.
Además, solicitamos a la Comisión que considere solicitar una opinión consultiva a la Corte Interamericana de Derechos Humanos para interpretar la Convención Americana y otros tratados de derechos humanos aplicables en las Américas en relación con las expulsiones a terceros países. Solicitamos que se consulte a las ONG al momento de formular las preguntas para la opinión consultiva. También solicitamos a la comisión que continúe solicitando información a los Estados.
Agradecemos también la presencia del Relator Especial de las Naciones Unidas y Representante Regional del ACNUDH y pedimos que ambas agencias realicen visitas a los países para seguir monitoreando dichas violaciones.
